Regentek Healthcare Private Limited is a private limited company incorporated under the provisions of the Companies Act, 2013 with its registered office at 35, Chandivali Village Saki Vihar Road, Sakinaka, Mumbai, Maharashtra, India, 400072 (“Company”, “we”, “us” or “our”) which is committed to protecting and respecting user’s (“you”, “your”, or “User”) privacy in connection with (a) the use of its website [•](“Website(s)”); (b) use of its mobile applications (“App(s)”) and together with Website collectively referred to as “Platforms”; and (c) any other products, services, features and content accessible or downloadable from the Platform or any other App, service or product licensed, downloaded or otherwise accessed by the User’s through third party websites or sources, including Google Play Store and iOS App Store, (collectively referred to as the “Services”). The Services provided by the Company, may be updated from time to time at the sole discretion of the Company.

The Company values the trust placed in it by Users and the privacy of the Users is important to the Company. This privacy policy is the privacy notice under the applicable law (the “Privacy Policy”) together with the terms of use that describe how the Company collects, uses, and discloses the information provided by the Users of the Platforms. Every User who accesses or uses the Platforms shall be bound by this Privacy Policy.

This Privacy Policy is published pursuant to Telemedicine Practice Guidelines, 2020, Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 and Information Technology (Intermediaries Guidelines) Rules, 2011 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 or any applicable data privacy provisions.

The User understands and agrees that the Company may collect, use, disclose, and process the User’s personal data in accordance with the terms outlined herein. If the User does not agree to the processing of their personal data as described in this Policy, the Company kindly requests the User that they refrain from using the Services or accessing the Platform and any ancillary services provided therein.

By mere access or use of the Platforms, the User expressly consents to our use and disclosure of the User’s personal information in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to the Terms and Conditions.

The Company reserves the right to update this Privacy Policy at any time, with or without any notice. In the event of any changes to this Privacy Policy, the Company will publish those changes or update the privacy policy on its Website and the same shall be effective from that date onwards. The User consent shall be obtained within relevant timelines, as may be required under applicable law, of such changes being effective. The Users are however, advised to review the policy periodically for any changes, the continued use of Services constitutes the User’s consent to any updates, except where explicit consent is required by law then the update shall be notified either by sending an email or a notification through the App, the User is advised to carefully read such notices and provides their consents.

When registering or requesting for appointment, the Company will collect your name, your mobile phone number and email address. Additionally, you may be prompted to select an exclusive username and password, which will serve as your credentials for accessing the User account. As part of the registration process, you may also have the choice to provide a security question and its answer, which will be utilized solely for the purpose of password reset (as and when required). Your name and email address will be used for the purpose of notifying you about new services, product releases, upcoming events, and any modifications made to this Privacy Policy, if required by applicable law.

By accessing and using the Services, registering an account, visiting the Platform through the Website, or through any interaction with us via emails, telephone calls, or other correspondence or any other medium, the User represents that they are at least 18 (eighteen) years old and acknowledges, agrees, and explicitly consents to the practices, requirements, and policies outlined in this Privacy Policy.

The Company shall not use the User’s information in any manner except as provided under this Privacy Policy. This Privacy Policy sets out the type of information collected from the Users, including the nature of the sensitive personal data or information, the purpose, means, and modes of usage, and specifying the manner and recipients with whom the Company may share the said information. The Company and its authorized third parties will collect information pertaining to the User’s identity, demographics, medical history, and related evidentiary documentation. This information (including updates) will be collected for registering the User and/ or as and when the User wishes to avail of any Services or during any interaction (for instance promotional offers, providing updates or feedback, or customer support, or registering or resolving any grievance) with the authorised personnel of the Company via any offline or online medium including Facebook, Instagram, emails, telephone calls, WhatsApp, etc. All the information provided to the Company by a User, including personal information and personally identifiable information, is provided by the User voluntarily and that the User was under no undue pressure or influence to provide the same.

The User always has the option to not provide information by choosing not to use a particular Service or a particular feature available on the Platforms. The User must ensure strict caution while giving out any personally identifiable information about himself/herself/itself or his/her family members in use of any of the Services. The User acknowledges that any personal information or personally identifiable information provided by it to the Company while availing/ inquiring about the Services or accessing the Platforms, may be used by the Company in order to reach out to the User and provide/ customize the Services for the said User in a better and efficient manner.

The Company may collect, process, and disclose the personal information, sensitive personal information and non-personal information of the User for the Services including through the usage of cookies and similar technologies either directly and/or through third parties to enhance the benefits and experience of using the Services including instances such as:

  • By accessing the Company’s Platforms;
  • By accessing social media pages of the company including but not limiting to Instagram, You Tube Channel, Facebook, Thread etc;
  • Registration for any kind of Services;
  • When you fill out the patient registration form;
  • When you provide details of a medical practitioner/ doctor/ physician;
  • Using third-party credentials, such as social networking sites, to access the Services;
  • Making any booking on the Platforms;
  • When the User interacts with the Company or its authorised service providers using various means, including telephone calls (which may be recorded), letters, fax, face-to-face meetings, social media platforms, and emails;
  • When the User provides feedback or lodges complaints;
  • Other data the User chooses to provide. The above instances are not intended to be exhaustive but rather represent common instances where the User’s Personal Data may be collected and used by the Company, in order to provide the efficient Services.

The Privacy Policy applies to information collected and processed by the Company including, but not limited to, the following:

  • Personal information is information related to a visitor;
  • or a combination of pieces of information that could reasonably allow him/her to be identified. Personal information may consist of full name, personal contact numbers, residential address, email address, gender, or date of birth. While information such as date of birth in isolation may not be enough to uniquely identify the visitor, a combination of full name and date of birth may be sufficient to do so.

    • Financial information such as bank account details, credit card details, debit card details or other payment instrument/ mode details;

    • Medical records and history;
    • Biometric information;
    • insurance data (such as your insurance carrier and insurance plan);
    • Any detail relating to the above personal information categories as provided to the Company for providing the Services; and
    • Any of the information received under the above personal information categories by the Company for processing, storing, or processed under lawful contract or otherwise.
  • The Company may also collect information about the devices used to access its Platforms, including the hardware models, device IP address, operating systems and versions, software, preferred languages, unique device identifiers, serial numbers, browser type, mobile app, file names and types, and plugins. It may also collect location data require access to the User’s geolocation, and require access to call logs, SMS, camera, and device gallery. This is to read any OTPs sent to the User, allow the User to upload pictures of his/her documents, etc.
  • Additionally, the Company may also collect information regarding (i) User behaviour information – including but not limited to, the number of appointments booked, the type of doctors consulted, whether a doctor/facility has been consulted/visited repeatedly, the location of the doctor and/or center visited and the types of services booked; and (ii) Cookies and tracking pixels and similar technologies to understand how the User navigates through the Platforms to learn his/her preferences. Cookies are small text files that web servers place on your device; they are designed to store basic information and to help websites and apps recognize your browser. The Company may use both session cookies and persistent cookies. A session cookie disappears after the User closes the browser. A persistent cookie remains after the User closes the browser and may be accessed every time the User uses the Platform. Please note that any information that is freely available or accessible in the public domain or furnished under the Right to Information Act, 2005, or any other law for the time being in force shall not be regarded as sensitive personal information or Personal Information of a visitor or of a User.

The Users can modify, correct and update the data already provided by him/her/it which has been collected pursuant to his/her/its decision to become a User. Any grievances in relation to the information shared by the User with the Company may be brought to the attention of the grievance officer mentioned herein.

A User may set or amend his/her/its web browsers to delete or disable cookies. If a User chooses to disable cookies on his/her/its computer or mobile telecommunication device, it may impair, degrade, or restrict access to certain areas of the Platforms. Merely closing the web browser should ordinarily clear all temporary cookies installed by the Company. However, Users are encouraged to use the “clear cookies” functionality of their browsers to ensure deletion, as the Company cannot guarantee, predict or provide for the behaviour of the equipment of all the Users of the Platforms.

The Company does not store personally identifiable information in cookies. Information collected by the Company, by any means whatsoever, that does not personally identify the User as an individual (such as patterns of utilization described above) is exclusively owned by the Company and may be used by the Company and third-party service providers for technical administration of the Platforms, user administration, research, development, and other purposes. Additionally, the Company may sell or otherwise transfer or grant license of such research, statistical, or intelligence data in an aggregated or non-personally identifiable form to its parent company, group companies, subsidiaries, associates, affiliates, suppliers, vendors, sister concerns, service providers, and service partners and other third parties (collectively referred to as “Other Parties”).

Due to the communications standards on the Internet, when a User visits the Platforms, the Company automatically receives the uniform resource locator of the site from which such User visits the Platforms, details of the website such User is visiting on leaving the Platforms, the internet protocol (“IP”) address of each User’s computer operating system, type of web browser the User is using, email patterns, and the name of the User’s internet service provider. This information is used solely to analyze the overall User trends and to help the Company in improving and updating its Services. Please note that the link between the User’s IP address and the User’s personally identifiable information is not shared with third parties without such User’s permission or except when required by law or to provide or facilitate the User with the Services. Notwithstanding the above, the User acknowledges the Company’s right to share the data collected including the personal information in an unidentifiable form aggregate findings, and not the specific data with advertisers, sponsors, investors, strategic partners, and others in order to help grow the business of the Company. The amount of information sent to the Company depends on the settings of the web browser used by the User to access the Platforms. The User may refer to the browser used, if the User wishes to learn what information is provided to the Company.

The Company does not exercise control over the websites displayed as search results or links from within the Services. These other sites may place their cookies or other files on the User’s computer, collect data, or solicit personal information or financial information from the Users, for which the Company shall not be held responsible or liable. The Company does not make any representations concerning the privacy practices or policies of such third parties or terms of use of such websites, nor does the Company guarantee the accuracy, integrity, or quality of the information, data, text, software, sound, photographs, graphics, videos, messages or other materials available on such websites. The inclusion or exclusion does not imply any endorsement by the Company of such websites, the website’s provider, or the information on the website.

The Company may allow other companies or entities to serve advertisements to Users. These companies or entities include third-party advertisement servers, advertisement agencies, advertisement technology vendors, and research firms. The Company may target some advertisements to Users that fit a certain general profile. The Company does not use personally identifiable information to target advertisements to specific Users. In the course of serving advertisements or optimizing the Services to its Users, the Company may allow authorized third parties to place or recognize a unique cookie on the User’s browser.

The Company may keep records of telephone calls received from and made to Users for the purpose of administration of Services, research and development, training, business intelligence, business development, or for User administration. The Company may share the telephone records with third parties when required by law or when required to provide or facilitate the User with the Services.

The Company may however, contact and reach out to its Users or visitors from time to time either through phone calls or WhatsApp’s or though messages, in order to inform and updated them about the new Services being provided by the Company.

When a User visits or uses the Platforms, the Company may access, collect, monitor, and/or remotely store data in relation to the User’s location, which may also include global positioning system coordinates or similar information regarding the location of the device using which the User has visited or used the Platforms. The location data does not collect or share any personally identifiable information about the User.

The Company does not knowingly collect personal data from children (only persons above the age of 18 shall be permitted to use the Services as provided in the Terms of Use).In the event a person below the age of 18 is required to use the Services, express consent of a guardian or parent is required and the Company reserves the right not to provide any Services to such persons unless it verifies the consent and other information as may be required in accordance with its policies or applicable law. It is expressly understood that the User’s parents or legal guardians shall be entirely responsible and liable for all aspects of compliance with these Privacy Policy on behalf of such covered User’s who are minors.

When you voluntarily send us electronic mail / fillup the form, we will keep a record of this information so that we can respond to you. We only collect information from you when you register on our site or fill out a form. Also, when filling out a form on our site, you may be asked to enter your: name, e-mail address or phone number. You may, however, visit our site anonymously. In case you have submitted your personal information and contact details, we reserve the rights to Call, SMS, Email or WhatsApp about our products and offers, even if your number has DND activated on it. All the personal information that the User voluntarily provides the Company with including sensitive personal information, may be used by or processed by the Company or its partners for various purposes including but not limited to the following:

  • To contact the User via phone, SMS, WhatsApp or email for appointments, technical issues, payment reminders, deals and offers, and other announcements;
  • To share with business partners and third-party contractors for the provision of specific services to the User;
  • To provide effective services by sharing personal information to third-party contractors working on behalf of the Company. Such third parties generally do not have the right to share information and the same is subject to their privacy policy(cies) and the Company takes no responsibility for the same;
  • To operate and improve and upgrade the Services;
  • communicate with the User (including to respond to his/her requests, questions, feedback, claims or disputes) and to customize and improve the Services;
  • protect against and prevent fraud, illegal activity, harm, financial loss and other legal or information security risks, if any;
  • To perform studies, research, and analysis for improving Company’s information, analysis, services and technologies; and ensuring that the content displayed is customized and relevant to User’s interests and preferences;
  • provide the Users with offers (including for financial products and/or services), personalized services and recommendations and improve their experience on the Company’s Platforms;
  • provide privileges and benefits to the User, marketing and promotional campaigns based on the User’s profile created by him/ her on the Platform;
  • To generate aggregated data to prepare insights to enable the Company to understand the User’s behaviour, patterns and trends with a view to learning more about the User’s preferences or other characteristics, in order to provide efficient Services;
  • To send promotional mailings from the Company or any of the channel partners via SMS, WhatsApp, email, or other media/ channels of communication;
  • To advertise products and services of the Company and third parties;
  • To administer or otherwise carry out its obligations in relation to any agreement the User has with the Company
  • To build User’s profile on the Platform and publish any such information on the Platform;
  • Government agencies or authorities when such disclosure is requisitioned under any applicable law or judicial decree, mandated under the law to obtain information after thorough verification of proper authorization of the said Government agency or authorities;
  • Information for verification of identity;
  • To investigate, prevent, or take action regarding illegal activities, suspected fraud, violations of our terms of use, breach of our agreement with you or as otherwise required by any law, rule, regulation, law enforcement agency, governmental official, legal authority or similar requirements or when The Company, in its discretion, deems it necessary in order to protect its rights or the rights of others, to prevent harm to persons or property, to fight fraud and credit risk;
